필리핀에서 지속되는 활동가 살해를 규탄한다!



34년 전 오늘은 필리핀에서는 수 만명의 생명과 자유를 앗아가는데 시발점이 된 계엄령이 선포된 날이다. 필리핀 민중들의 힘으로 계엄령은 역사 속으로 사라지는 듯 했지만, 아로요 대통령의 집권 5년 동안 필리핀에서는 무고한 생명 751명이 살해를 당했고, 184명이 실종되었다.



불행히도, 이는 인권탄압으로 악명높았던 마르코스 집권 14년간 발생률에 버금가는 것으로, 그 피해자는 진보진영에서 활동하는 농민, 노동자, 인권활동가, 변호사, 성직자, 기자들과 일반 민중들이다.



문제는, 이런 불행한 사건들이, 필리핀 아로요 정부가 미국과 함께 추진하고 있는 테러와의 전쟁과 신자유주의 정책 하에서 체계적이고도 조직으로 발생하고 있다는 점이다.



필리핀 아로요 정부는 미국이 주도하는 테러와의 전쟁에 적극 호응하며 일명 '자유 수호 작전'이라는 이름 하에 미국과 합동 군사작전을 펼치고 있다. 그 일환으로, 아로요 정부는, 1992년 일명 ‘국가보안법(anti-subversion act)'을 개정한 뒤 평화 협상을 진행해 오던 필리핀 공산당 등 공산주의 계열 단체들을 2005년 6월 불법 단체로 공공연히 규정하고 이들을 완전 궤멸하겠다고 선포하며 전면전에 나섰다. 그리고 더 나아가, 신자유주의 정책에 반대하거나 정부를 비판하는 단체들도, 활동의 목표와 방식 여하를 떠나, 공산주의 계열 단체로 분류한 뒤 무력으로 진압하고 있다. 그리고 그 과정에서 살인과 강제실종 등 각종 인권탄압을 가하고 있다.



특히, 아로요 정부가 부정선거, 부정부패, 그리고 신자유주의 정책의 실패 등으로 최대 집권 위기를 맞고 있는 올해 1월부터 5월까지만 해도 75명의 살인사건과 25명의 강제실종 사건이 발생했다.



필리핀 정부는, 살인과 강제실종 사건이 자신들과 무관하다고 주장한다. 그러나, 살인 또는 강제실종 사건의 피해자들 대다수가 진보진영과 좌파진영에서 활동하는 사람들이고, 일부 사건에서는 사건 발생 전 군부나 경찰들이 피해자를 협박한 사실도 밝혀지고 있다. 더구나, 필리핀 정부는 살인 또는 강제실종사건을 수사하거나 가해자들을 처벌할 의지가 없으며 이러한 불처벌의 만연은 오히려 더 많은 피해자들을 양상해 내고 있다. 따라서, 필리핀 민중들과 국제인권단체들은 필리핀 아로요 정부가 현재 일어나고 있는 일련의 사건에 깊숙이 관여하고 있다고 보고 있다.



활동가들에 대한 폭력적 탄압과 물리적 공격은 그 자체가 불법일 뿐 아니라, 국민 전체의 인권과 생존권을 침해하는 매우 중대한 인권침해 행위인 것이다.



우리는 2005. 10. 20 필리핀 네슬레 노조위원장 포르투나의 살해 사건에 대해서도 필리핀 정부에게 진상 규명과 책임자들에 대한 처벌을 요구한 바 있다. 그러나 필리핀 정부는 조사를 해태하고 가해자들에게 사실상의 면책 특권을 부여함으로써 이들의 인권을 존중하고 보호할 의무를 이행하지 않았으며, 활동가들에 대한 지속적인 살해 및 실종을 부추기고 있다.



오늘도, 목숨을 걸며 피 냄새 나는 일상을 살아야 하는 필리핀 활동가들에게 뜨거운 연대를 표하며, 필리핀 정부에게 아래와 같은 사항을 강력히 요구하는 바이다.



하나. 필리핀 정부는 인권활동가, 노동운동가, 재야 정치인 등에 대한 살인과 납치 등 인권탄압을 중단하라.



하나. 필리핀 정부는 살인과 납치 등 인권탄압의 진상을 철저히 규명하고 책임자를 처벌하라.



하나. 필리핀 정부는 국가안보라는 정책 하에 추진하고 있는 운동단체와 정치 조직에 대한 탄압을 즉각 중단하고, 인권, 노동, 농민, 정치 운동을 보장하라.



하나. 필리핀 정부는 필리핀 공산당 등 공산주의 계열 단체들과 체결한 평화 협정의 이행을 위하여 평화 협상에 나서라.

Joint Statement



We strongly condemn the ongoing extra-judicial killings

in the Philippines!



Thirty four years ago today, the martial law was declared that subsequently deprived freedom and lives of tens of thousands of people in the Philippines.



Due to the struggle of the people the end of the Marcos regime seemed to signal and end to the martial law. However, about 751 innocent persons have been extra-judicially killed and 184 have been forcibly disappeared over the last 5 years under the Gloria Macapagal-Arroyo government.



Unfortunately, the extent of the current violence is equivalent to that which occurred for 14 years under Marcos' rule. Most of the victims are reported to be peasants, labors, human rights defenders, lawyers, religious activists, journalists and ordinary citizens working towards progress of democracy and human rights.



These killings are taking place systematically in the name of the 'War against Terror' and 'Neo-liberalism' by the Arroyo government with the promotion of the U.S government.



The Arroyo government has actively responded to the so-called "war against terror" mainly led by the U.S. government and has conducted combined military operations with the U.S. under 'Freedom Protection Plan'. As a part of this action, in June 2005, the Arroyo government illegalized several left oriented organizations including the Communist Party of the Philippines with which it had been negotiating for peace process and publicly announced an 'all-out-war' to wipe them out, after the revision of anti-subversion act in 1992. Furthermore, the Arroyo government has been repressing groups voicing their opposition towards the government and its neo-liberal policy with force, notwithstanding their aim and way of activities, by labeling them as communists. In this situation, all types of killings, enforced disappearances and other abuses have been taking place.  



In particular, we notice with grave concern that 75 extra-judicial killings and 25 enforced disappearances occurred over the first 5 months in 2006. All these violations took place while the Arroyo government is facing critical political crisis due to fraudulent elections, corruptions and failure of the neo-liberal policy.  



The Philippine government insists that they are not accountable for those killings and enforced disappearances. But, most of the victims are from the progressive or left oriented groups and in some cases, it was revealed that the victims had been threatened by the military and the police before they are killed. Moreover, the Philippine government has not shown any serious willingness to investigate these cases and bring those responsible to justice. Due to the government's apparent inaction, impunity prevails in the country and more citizens are victimized. Thus, people in the Philippines as well as the international human rights community have a view that the Philippine government is responsible for these killings and other abuses.  



Violent suppression and attack against the human rights defenders is not only illegal itself but also serious violation of fundamental rights, in particular the right to life, of all citizens in the Philippines.  



We had previously urged the Philippine government to investigate the killing of Mr. Diosdado Fortuna, the labor union leader of Nestler Philippines, on October 20, 2005 and bring those responsible to justice. But the Philippine government had neglected to investigate this case and rather gave the perpetrators de facto impunity. Such the government's failure of fulfilling its responsibility to respect and protect human rights of its citizens encourages continuing extra-judicial killings and enforced disappearances of the activists.



While expressing our strong solidarity to the activists of the Philippines who have to risk their lives for their daily activities, we strongly urge the Philippine government to:  



1. Stop killings and abductions against its citizens including human rights defenders, labor activists and political activists;



2. Conduct thorough and impartial investigation into all the cases of killings and enforced disappearances and bring those responsible to justice;



3. Immediately stop suppression on political and civic organizations in the name of 'national security' and allow labour, peasants, political and human rights groups to conduct their activities freely;  



4. Take genuine steps toward the peace process in the country and implement the peace agreement previously concluded with the left oriented groups including the Communist Party of the Philippines.
